Agreement to Terms

By downloading, installing, or using the SwipeSweep mobile application ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access the Service.

Description of Service

SwipeSweep is a mobile application that helps users organize their photo libraries by:

• Detecting and identifying blurry, duplicate, or low-quality photos
• Providing recommendations for photo cleanup
• Offering tools to help free up storage space on your device
• Analyzing video files for cleanup suggestions

User Responsibilities

When using SwipeSweep, you agree to:

• Use the Service only for lawful purposes and in accordance with these Terms
• Not use the Service in any way that could damage, disable, or impair the Service
• Not attempt to gain unauthorized access to any portion of the Service
• Take full responsibility for backing up important photos before using cleanup features
• Review all deletion recommendations carefully before confirming any actions

Privacy and Data

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices regarding your personal data and photos.

Key privacy points:

• All photo analysis is performed locally on your device
• We do not store, access, or transmit your photos to our servers
• We may collect anonymous usage analytics to improve the Service
• We use Google AdMob for advertising, which may collect advertising data

Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of SwipeSweep and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks may not be used in connection with any product or service without our prior written consent.

Third-Party Services

Our Service may contain links to third-party services or integrate with third-party services such as:

• Google AdMob for advertising
• Apple services for app functionality
• Analytics and crash reporting services

These third-party services have their own terms and privacy policies, and your use of such services is governed by their respective terms.

Disclaimers

The information on this Service is provided on an "as is" basis. To the fullest extent permitted by law, we exclude all representations, warranties, and conditions relating to our Service and the use of this Service, including:

• Any warranties implied by law of satisfactory quality, fitness for purpose, and/or the use of reasonable care and skill
• Any warranty that the Service will be uninterrupted or error-free
• Any warranty regarding the accuracy or reliability of photo analysis results

Limitation of Liability

In no event shall SwipeSweep, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

Indemnification

You agree to defend, indemnify, and hold harmless SwipeSweep and its licensees, licensors, employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees).

Termination

We may terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will cease immediately.

App Store Terms

If you download our app from the Apple App Store, you acknowledge and agree that:

• These Terms are between you and SwipeSweep only, not Apple
• Apple has no responsibility for the Service or content thereof
• Apple has no obligation to provide maintenance or support services
• Apple is not responsible for addressing any claims by you or third parties

Governing Law

These Terms shall be interpreted and governed by the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
